Following the entry into force of the provisions of the European regulation on artificial intelligence (RIA) which concern artists, creators and rights holders, Rachida DATI, Minister of Culture, firmly states once again: "The defined framework must allow for a fair sharing of value between the different stakeholders. Fair remuneration for authors, creators and media actors is a condition of our economic and cultural sovereignty."
We have ensured that the Code of Good Practice fully incorporates French positions on copyright by emphasizing, on the one hand, that its provisions do not replace or exempt compliance with the legislation that applies in terms of copyright, and on the other hand, the prohibition of any training on pirate sites.
The Minister points out that any use of a protected work, particularly in AI systems, is subject to authorization and remuneration, within a secure legal framework.
In support of rights holders, the Minister of Culture, in conjunction with the Minister Delegate for Artificial Intelligence and Digital Technology, has taken a unique initiative in Europe by launching a consultation between representatives of the cultural and media sectors and AI model developers to agree on a remuneration model. The conclusions of this consultation will be submitted to her next November.
The Minister points out that the European regulation on AI cannot in any way call into question the effectiveness of the 2019 DAMUN directive (Directive on copyright in the digital single market), which strictly regulates the use of protected works by reaffirming the exclusive rights of the owners.
