France : workshop on the copyrightability of AI output

The following answer to the consultation of the  Intellectual Property Council in France has been sent on 28th November 2025
   

The consultation focusesd on the copyrightability of the AI output.

The essence of CEPIC's answer is that the human-centric approach to  copyright (authors' rights) should be preserved, while providing  protection to the output under certain circumstances or with other  legal means than copyright (authors rights) - for example a sui  generis right (protection of the "investment"). A workshop animated by Prof. Alexandra Bensamoun, rapporteur on behalf of the Intellectual Property Office, took place on 16th June 2026. A draft report was presented. The report supports a human-centric approach, differenciating between hybrid and synthetic content.
