Byby Prof Dr Christian DonleOn December 1st, 2009 the Treaty of Lisbon became valid as the basic EU set of rules. Remarkably, the Treaty of Lisbon contains a Charter of Human Rights compulsory for all Member States of the European Union and all national or European Courts.

Among this Charter of Human Rights Art. 17 protects the right to property. Everyone has the right, to own, use and dispose of his or her possessions. No one maybe deprived of his or her possessions except in the public interest.

According to Art. 17 (2) “intellectual property shall be protected.”
This is the first time in the European history, that intellectual property is explicitly protected by a human rights charter.

Picture agency sued over the publication of Christo images

The artist Christo has once again taken legal action against a picture library and won. The Berlin District Court decided on 27 September 2011 to stop a picture agency from distributing photographs of the works created by Christo and his late wife Jeanne-Claude.

The German Association of picture agencies, BVPA, asked copyright attorney Professor Dr Christian Donle for a statement on this judgement:

The wrapped Reichstag and the freedom of panoramic views

According to press releases, the Berlin District Court has pronounced an injunction against a picture agency. They have also been asked to provide information and have been condemned to pay damages because the agency distributed photographs of the wrapped Reichstag. The images had been taken by a photographer – not Christo himself.

Key points of judge Chin's rejection of the proposed Google Book Settlement

On 22 March 2011, Judge Denny Chin issued his much anticipated ruling in the Google Book Search class action lawsuit pending before the United States District Court for the Southern District of New York.

Judge Chin made clear that the proposed settlement was neither fair, adequate nor reasonable. In rejecting the proposed Amended Settlement Agreement (“ASA”) under Rule 23 of the Federal Rules of Civil Procedure, Judge Chin noted that it would:

The launch of any CEPIC Congress is always a great social affair where friends and business acquaintances are reunited after another year. CEPIC invites all delegates and participants of the CEPIC Congress 2010 to the Welcome Drinks Evening at the Aviva Stadium.

At 8.30 H, delegates were enthralled by a Performance of Irish Dancers and then the CEPIC President, Christina VAUGHAN, introduced this Congress’s selected charity, Barrettstown with a moving presentation by Benji BENNETT.
