The second document is a powerpoint presentation outlining the main elements of the Hargreaves Report. The presentation was made by Lawyer Lisa Peets at the IP Guest Session organised by ICOMP in London on 8 September 2011.

The Directorate General for the Internal Market and Services has asked stakeholders for their opinion about copyright levies. CEPIC has been invited to contribute its opinion.

CEPIC is the European organisation for press, stock and heritage picture agencies in Europe. It represents more than 1,000 companies in 17 countries.

In several earlier statements to the EU we have pointed out that we are not fond of Collection Societies for all kinds of reasons. In this case of private copying we cannot find any solution other than levies.

Statement on Collective Rights Management

With the growing number of collecting societies, there is an increasing need to define collective rights management as different European member states are permitting the collective management of different rights, so leading to a lack of harmonisation within Europe.

CEPIC believes that these rights need to be harmonised, especially in the new digital environment, so that:

  • a. authors receive an appropriate reward for the use of their work and the pursuit of creative avtivity
  • b. thus enabling authors to continue their creative and artistic work for which there would be little point if there were no adequate remuneration for exploitation of such work
  • c. stressing the importance of providing a high level of protection of intellectual property

Resolution on Collecting Societies

The resolution on Collecting Societies had been proposed at the CEPIC AGM 2002.

CEPIC which formally represents the picture industry in Europe of 900 picture agencies in 17 countries is the largest visual copyright organisation in Europe. Even so CEPIC picture agencies receive virtually no money for the copyright that they own despite the large revenues amassed by the collecting societies on behalf of authors. It is our opinion that such a monopoly is not in the spirit of free trade within Europe and the money is not being distributed in a manner which is open and fair, nor is it being distributed following proper consultation with the interested parties.
