ByAlamyIn a recent industry debate hosted by image agency Alamy the issue of ‘freenagers’ and their belief that all things on the internet are free was raised as causing concern, not just for the well documented and policed music and film industry but, for the professional photography industry too.

The generation that’s coming up, grew up with the internet, and the idea that the stuff on it is free is pervasive. It’s a huge problem and I don’t think we’ve reached the apex of the situation.Said Roy Clark, digital media and photography lecturer at City and Islington College.

APA joins copyright infringement lawsuit against Google

American Photographic Artists (APA) is joining the 15 plaintiffs in a lawsuit against Google. By joining the suit, APA alleges the “Google Book Search” program violates the copyrights of numerous photographers and other visual artists.

The lead plaintiffs include: The American Society of Media Photographers, Graphic Artists Guild, Picture Archive Council of America, North American Nature Photography Association, Professional Photographers of America, National Press Photographers Association, Leif Skoogfors, Al Satterwhite, Morton Beebe, Ed Kashi, John Schmelzer, Simms Taback and Gail Kuenstler Taback Living Trust, Leland Bobbe, John Francis, Ficara, and David W. Moser.

UK: Consumers given more copyright freedom

Changes to create greater freedom to use copyright works such as computer games, paintings, photographs, films, books, and music, while protecting the interests of authors and right owners, were announced today by Business Secretary Vince Cable.

These form part of the Government's response to creating a modern, robust and flexible copyright framework.

New measures include provisions to allow copying of works for individuals' own personal use, parody and for the purposes of quotation. They allow people to use copyright works for a variety of valuable purposes without permission from the copyright owners. They will also bring up to date existing exceptions for education, research and the preservation of materials.

At the initiative of President Barroso, the European Commission has today held an orientation debate on content in the digital economy.

Brussels, 5 December 2012

The digital economy has been a major driver of growth in the past two decades, and is expected to grow seven times faster than overall EU GDP in coming years. Online, there are new ways of providing, creating and distributing content, and new ways to generate value. This represents a challenge and an opportunity for all the creative industries, authors and artists and other actors in the digital economy.

CEPIC endorses the Briefing Paper to the House of Lords. The document is supported by BAPLA and was produced by Serena Tierney, Head of Intellectual Property at Bircham Dyson Bell LLP (with strong connections and parliamentary agents).

The paper covers issues which require further scrutiny at parliamentary level:

extended collective licensing
new exceptions to copyright
reduction of copyright terms for anonymous, pseudonymous and unpublished works

CEPIC agrees that the legislative proposals being put forward by the UK Government represent a 'serious threat' to the picture business and to rightsholders in their ability to generate income from copyright protection.

Linked Content Coalition and Rights Data Integration

On Tuesday 13 November, partners of the Linked Content Coalition will gather in Brussels for the second plenary session of the Linked Content Coalition and the kick-off meeting of the RDI project.

The plenary, which takes place in the morning, will provide an opportunity to inform all participants of the current progress of work, notably from the technical workstreams and discuss the next steps to come.

In the afternoon of the same day, the kick-off meeting of the RDI (Rights Data Integration) project initiated by the LCC will be held from 14:30 H. The main objective of the kick-off meeting is for everyone to meet and to have an opportunity to hear brief presentations on the various elements of the project and their interaction.

BySylvie FodorHadopi, French government agency for internet copyright protection in charge of the controversial “three-strike law”, released its report of activity in October – two years after it started activity in 2010.

Since it started activity, HADOPI sent:

  • 1,244,847 notices to infringers
  • 110,574 notices with acknowledgement receipt to repeat infringers
  • 363 letters indicating the criminal nature of the downloading activity
  • 18 cases were transmitted to the prosecutor
  • So far, one guilty verdict (*) and a fine settled at 150 €

In Germany, 60 % of the Magazines sell less than ever before. On the other hand, the circulation of Die Zeit, an important weekly paper, is growing. One of Germanys largest agencies, Picture Press, was sold by the owner (the publishing House Gruner & Jahr) to the German news agency DAPD, that also bought Sipa Press and the French dependence of Associated Press. DAPD is investing and growing constantly. Gruner & Jahr did not want to own an agency anymore in these times of struggle.

Photographer's Moral Rights Infringed: Delves-Broughton versus House of Harlot Ltd

BySwan Turton LLPJudgment in the case of Emma Delves-Broughton v House of Harlot Ltd has recently been published. This was a rare case addressing infringement of a photographer’s moral rights. The Patents County Court ruled that changes made to a photograph amounted to derogatory treatment of the claimant’s work.

Background: The defendant published on its website a modified version of a photograph taken by the claimant in 2005. The original photograph (see picture above) depicted a model in a forest setting. The defendant made a number of changes to the image before publication, including the removal of the forest background, reversal of the image and cropping.
